Article 21. Special Provisions.
Sec. 25-21-40. Fences.
(a) Interior and Corner Lots. Fences or walls at or under three feet six
inches in height may be placed along the front yard property line or within the
front yard setback area.
(b) Interior Lots. Fences or walls at or under
eight feet in height may be placed within the rear yard or interior side yard
setback areas.
(c) Corner Lots. Fences and walls greater than three feet six
inches in height up to a maximum of eight feet in height shall maintain a
minimum setback of ten feet from the street side property line. Fences and walls
three feet six inches in height or less may be located within ten feet of the
street side property line of corner lots.
(d) General. All fences over six
feet require a building permit.
(e) Swimming Pool Fences.
(1) The
swimming pool, or the entire property in which it is located, shall be so walled
or fenced as to prevent uncontrolled access by children from the street or
adjacent properties; and where located less then thirty feet from any property
line shall be screened by a fence or wall not less than six feet in height on
the side facing such property line. Said fence or wall shall be constructed so
that no object four inches in diameter can pass through.
(2) The fences
surrounding these pools shall be equipped with a self-closing and self-latching
gate. The latch to be at least four feet above ground level. (Amended during the
